Recommendations to the Netherlands MoD on its CHM policy

PAX, together with civil society partners Airwars, Center for Civilians in Conflict and Utrecht University, has been engaged in an ongoing dialogue with the Dutch Ministry of Defence, regarding necessary improvements to its current civilian harm mitigation policies and practices. These conversations (the so-called ‘Roadmap process’) have resulted in 16 recommendations to the MoD.

PAX is specifically concerned about the lack of a standing policy to meaningfully address civilian harm caused by Dutch military use of force, as well as limited transparency regarding potential civilian harm risks related to Dutch military contributions currently not covered by Article 100 of the Dutch Constitution. Additionally, PAX has made recommendations regarding the implementation of the political declaration on the use of explosive weapons in populated areas, which the Netherlands signed in November 2022.
